When using Cherry, you agree to:

Not use the App for any illegal, harmful, or unauthorized purposes.

Not engage in any activity that disrupts or interferes with the functioning of Cherry or other users' experience.

Not upload or share any content that is abusive, offensive, discriminatory, or infringing.

Not engage in any form of harassment, bullying, or inappropriate behavior towards other users.

Live Music Performances

3.1 Participation in Live Music Sessions:

Cherry facilitates live music performances where users can watch musicians perform in real-time. If you participate as a musician, you consent to your performance being streamed live to other users in the session.

3.2 User Content Sharing:

Any content you create and share during live music sessions, such as comments and reactions, will be visible to other users participating in the respective live music session.

Ownership and Intellectual Property

Cherry, including all content, features, and functionalities, is the property of the creators of Cherry and protected by intellectual property laws. The creators of Cherry retain all rights, title, and interest in and to the App and any content provided within the App.

Prohibited Activities

When using Cherry, you agree not to:

Violate any applicable laws, regulations, or third-party rights.

Use Cherry for any illegal, harmful, or unauthorized purposes.

Impersonate any person or entity or falsely represent your affiliation with any person or entity.

Engage in any activity that disrupts or interferes with the functioning of Cherry or other users' experience.

Attempt to gain unauthorized access to Cherry's systems or networks.

Use Cherry in a manner that infringes the intellectual property or privacy rights of others.

Termination

The creators of Cherry may, at their sole discretion, suspend, terminate, or restrict your access to Cherry at any time and for any reason, without prior notice or liability. Upon termination, all licenses and rights granted to you under these Terms will immediately cease.

Disclaimer of Warranties

Cherry is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. While we strive to provide a reliable and enjoyable service, we do not guarantee that Cherry will be uninterrupted, error-free, or free from viruses or other harmful components. You use Cherry at your own risk.

Limitation of Liability

To the extent permitted by applicable laws, the creators of Cherry and its affiliates, officers, directors, employees, agents, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses arising out of or in connection with your use of Cherry.

Modifications to the Terms

The creators of Cherry reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting the revised Terms within the App. It is your responsibility to review the Terms periodically. Your continued use of Cherry after the posting of any changes signifies your acceptance of the revised Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the creators of Cherry operate. Any legal actions or proceedings arising out of or relating to these Terms shall be exclusively brought in the competent courts of that jurisdiction.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be severed from the Terms without affecting the validity and enforceability of the remaining provisions.

Entire Agreement

These Terms constitute the entire agreement between you and the creators of Cherry regarding the use of the App, superseding any prior agreements or understandings.
